These Terms and Conditions ("Terms") govern your use of yacht charter services provided by Coastalya ("Company," "we," "us," or "our"). By booking or using our services, you ("Client," "you," or "your") agree to be bound by these Terms.
Please read these Terms carefully before making a reservation. If you do not agree with any part of these Terms, please do not use our services.
1. Acceptance of Terms
By accessing our website, making a reservation, or using our yacht charter services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.
1.1 Agreement Formation
- A binding contract is formed when we accept your booking request and send written confirmation
- These Terms apply to all services provided by Coastalya, including yacht charters, catering, and additional services
- Any modifications to these Terms must be agreed upon in writing
1.2 Eligibility
- You must be at least 18 years of age to make a booking
- You must have the legal authority to enter into this agreement
- You are responsible for ensuring all passengers comply with these Terms
2. Services Provided
2.1 Charter Services
Coastalya provides yacht charter services including:
- Bareboat and crewed yacht charters
- Day trips and extended voyages
- Private tours and sightseeing excursions
- Corporate events and special occasions
- Catering and hospitality services
2.2 Included Services
Unless otherwise specified, all charters include:
- Professional captain and crew
- Fuel for normal cruising within designated areas
- Basic safety equipment as required by Transport Canada
- Standard onboard amenities
- Insurance coverage as outlined in Section 7
2.3 Additional Services
The following services may incur additional charges:
- Catering and beverage service
- Extended cruising beyond standard range
- Water sports equipment and toys
- Photography and videography services
- Special event coordination
3. Booking and Payment Terms
3.1 Reservation Process
- All bookings must be made through our official website, phone, or authorized agents
- Reservations are subject to availability and confirmation
- We reserve the right to decline any booking at our discretion
3.2 Payment Schedule
- Deposit: 50% of total charter fee due upon booking confirmation
- Final Payment: Remaining balance due 14 days prior to charter date
- Additional Services: Payment due upon completion of service
3.3 Accepted Payment Methods
- Major credit cards (Visa, MasterCard, American Express)
- Bank transfers for bookings over $5,000 CAD
- Certified checks with prior approval
3.4 Pricing and Fees
- All prices are quoted in Canadian Dollars (CAD)
- Prices are subject to applicable taxes
- Fuel surcharges may apply for extended cruising
- Gratuities for crew are at your discretion but appreciated
4. Cancellation and Refund Policy
4.1 Client Cancellations
- More than 30 days: Full refund minus 10% processing fee
- 15-30 days: 75% refund of total charter fee
- 7-14 days: 50% refund of total charter fee
- Less than 7 days: 25% refund of total charter fee
- Day of charter: No refund
4.2 Weather Cancellations
- If weather conditions are deemed unsafe by the captain, full rescheduling or refund will be provided
- Weather decisions are made by our certified captains and are final
- We monitor conditions 24-48 hours before departure
4.3 Company Cancellations
- If we must cancel due to mechanical issues or other circumstances, full refund will be provided
- We will make reasonable efforts to provide alternative arrangements
- Our liability is limited to the charter fee paid
5. Safety Requirements and Conduct
5.1 Safety Compliance
- All passengers must comply with safety briefings and instructions
- Life jackets must be worn when required by crew
- Children under 12 must be supervised at all times
- No swimming without crew approval and supervision
5.2 Prohibited Items and Activities
- Illegal drugs or excessive alcohol consumption
- Weapons or dangerous items
- Smoking in enclosed areas
- Activities that may damage the vessel or endanger passengers
5.3 Captain's Authority
- The captain has final authority on all safety matters
- The captain may terminate the charter for safety violations
- No refund will be provided for charters terminated due to misconduct
6. Liability and Insurance
6.1 Limitation of Liability
To the maximum extent permitted by law, Coastalya's liability is limited to the total amount paid for charter services. We are not liable for:
- Personal injury or property damage not caused by our negligence
- Weather-related delays or cancellations
- Lost or damaged personal belongings
- Consequential or indirect damages
6.2 Insurance Coverage
- All vessels carry comprehensive marine insurance
- Public liability insurance covers third-party claims
- Passengers are advised to carry personal travel insurance
6.3 Indemnification
You agree to indemnify and hold harmless Coastalya from any claims arising from your violation of these Terms or applicable laws.
7. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your personal information.
7.1 Information Collection
- We collect information necessary to provide charter services
- Emergency contact information is required for all passengers
- We may use photos taken during charters for marketing purposes unless you opt out
8. Governing Law and Disputes
8.1 Applicable Law
These Terms are governed by the laws of Ontario, Canada, and applicable federal maritime law.
8.2 Dispute Resolution
- We encourage resolution of disputes through direct communication
- Disputes may be submitted to binding arbitration in Toronto, Ontario
- Court proceedings, if necessary, must be filed in Toronto, Ontario
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance of the new Terms.
